Any arbitration proceeding conducted pursuant to this Arbitration Agreement shall be administered by the American Arbitration Association (“AAA”) in accordance with the Consumer Arbitration Rules that come into effect at the time of commencement of arbitration proceedings, as modified by the terms set forth in this Agreement. Copies of these rules may be obtained from the AAA (www.adr.org) website (the “AAA Rules”) or by phone from the AAA at 1-800-778-7879. Notwithstanding the foregoing, the arbitrator, if you so wish and is in due form on the basis of the facts and circumstances of the claims presented, is free to choose another set of AAA rules, but in no event will the arbitrator consolidate more than the claims of a person or, on the other hand, by any form whatsoever representative, collective or class process. The parties may, by mutual agreement in writing, select another arbitrator. The Lyft platform offers a marketplace where people looking for transportation to certain destinations (“drivers”) can be compared to transportation options to such destinations. One option for drivers is to ask carpool drivers who travel to or through these destinations (“drivers”). In summary, the driver and the driver are called “users” and the transportation services provided by drivers to drivers are called “carpooling services”. As a user, you allow Lyft to compare you to a driver or driver based on factors such as your location, estimated time to pickup, your goal, user preferences, and platform efficiency, and cancel an existing match and rematch based on the same considerations. Any decision by a user to offer or accept ride-sharing services is a decision made at the user`s sole discretion. Any carpooling service provided by a driver for a driver constitutes a separate agreement between those persons. . .
